Given the frequent inquiries from professionals, we have oriented this article to guide journalists and/or media professionals.

 

What is an I VISA?

(I) visas are for foreign media representatives. Included within it, there are members of the newspaper, radio, film and printing industries, who temporarily travel to the United States. These trips can be to work in your profession. As well as to participate in informative or educational activities of the media, essential for the foreigner.

In order for professionals to carry out their activities in the United States, they must have their headquarters in a foreign country. Additionally, they should be informational in nature and generally associated with the process of newsgathering and reporting on current events.

 

As a foreign media representative, you will not be able to travel to the United States and work in your profession without an I nonimmigrant visa. Even if you are a citizen of a country that participates in the Visa Waiver Program (VWP).

In the event that you attempt to travel to the United States without the proper visa, the Department of Homeland Security (DHS) will deny you admission at a port of entry. It can happen at airports, seaports or border crossings.

In the event that you are currently in the United States and wish to request a change of status from another immigrant classification to I nonimmigrant status, you must file the corresponding application with the U.S. Citizenship and Immigration Service (USCIS).

In this presentation you must accompany your application with evidence of your current status and a letter from the foreign media outlet that employs you. You must also describe your type of employment and demonstrate that you are a representative of said media outlet. This also applies if you currently have I nonimmigrant status and wish to apply for a change of employer or media outlet.

 

It is important to know that those who have had an I Visa during the last year and plan to travel on behalf of the same publication or program, need to present proof of work done during the previous trip to the United States.

In the event that you plan to travel to the United States on behalf of a different publication or program, you will need to submit proof of the end result of your previous trip to the United States. Also, proof of recently completed work with the new company.

We always recommend to our clients that apart from being able to apply for an I Visa they can also keep their Tourist Visa at the same time.

 

What do I need to apply for I visas?

USCIS requires applicants to meet the following requirements in order to be eligible for this type of visa:

 

  • Representing a foreign media outlet (press, radio, film, or other foreign media);
  • Be scheduled to travel to the United States to work solely in that profession;
  • Have a head office in a foreign country.

Can I apply for the I visa if I am a freelance journalist?

Employees of independent production companies and freelance media workers may qualify for an I-Visa.

They apply to that case if they are working under contract on a product that is going to be used as news value or as a documentary that is not primarily for entertainment or advertising purposes.

The employee must be a holder of credentials issued by the Association of Professional Journalists. It is important to note that consular officers may request to see such credentials before awarding requested I visas.

 

What is the cost and procedure?

When the spouse of an I visa holder did not apply for their visa at the same time as the main applicant, he/she will need to file their own forms. You will need to present a copy of the visa of the main applicant and must accompany the certificate of your marriage or relationship.

 

The spouse and children of an I visa holder may study without restriction but may not work under a derivative visa. Therefore, if he or she is seeking employment, the appropriate work visa will be required.

In case the spouse or children do not intend to live in the United States with the I visa holder they may be eligible and apply for a B1-B2 visitor visa.

A permanent labor certification is a document issued by the US Department of Labor (DOL) that allows a US employer to hire a foreign worker to work permanently in the United States.

Below, we’ll help you better understand the Permanent Labor Certification (PERM) program and how it can benefit you. This program is currently very useful in the workplace for both a US employer and a foreign worker.

Many of our clients are interested in this program due to the high job offer that currently exists in the United States and the low supply of available workers.

This program turns out to be very attractive for foreign workers since it can be the beginning of their path to permanent residence. But, on the other hand, it is also beneficial for US employers because of the lack of supply of available workers in the United States that fully impacts their businesses. This causes economic stagnation and frustrates their growth projects. That is why there is a good vision of this program since it opens the door to business projections and the flow of foreign workers within their organizations.

 

What does this program consist of?

The United States Department of Labor (DOL) created the Permanent Labor Certification Program (PERM) on March 28, 2005. It is essentially the first step in the employment-based lawful permanent residence (green card) application process.

 

To qualify for this program you must first meet the following requirements:

 

  • Must have an existing permanent job offer from a US employer.
  • That there are no capable, willing, qualified and available native workers for the position.
  • The US employer is required to build and maintain an audit file with additional evidence of recruitment attempts.
  • Salaries offered are required to be equal to or greater than the prevailing wage.

The DOL processes Applications for Certification of Permanent Employment (Form ETA 9089). The date the DOL receives the labor certification application is known as the filing date and is used by USCIS and the Department of State as the priority date. After the DOL certifies the labor certification application, the Immigrant Petition for Alien Worker (Form I-140) must be sent to the USCIS Service Center.

The certification is valid for 180 days and expires if it is not submitted to USCIS within this period.

It is important to note that, in most cases, before the US employer can file an immigration petition with US Citizenship and Immigration Services (USCIS), the employer must obtain a DOL Employment and Training Administration (ETA) certified labor certification application. This certification determines that there are not enough able, willing, qualified, and available US workers to accept the job opportunity in the intended area of ​​employment and that the employment of the foreign worker will not adversely affect the wages and working conditions of similar workers (US workers employed).

 

In order to obtain an immigrant visa (green card), the PERM requires approval.

Once the employer obtains that approval, the employer can file a green card petition on your behalf and be the start of a residence in the United States.

What is a prevailing wage?

It is a different wage than state or federal minimum wages. This salary is the lowest that the employer can pay the beneficiary for the work that he intends to perform. Not only must the employer agree to pay the beneficiary at least this salary, but the employer must also demonstrate that it is financially capable of paying this salary.

In order to apply for a Prevailing Wage Determination (PWD) for a Non-Agricultural Immigration Program, the employer must complete form ETA-9141 and submit it to the National Center for Prevailing Wage. Said presentation can be made electronically through the FLAG system.

If you have started an immigration process, this article is for you. Your appointment for biometric data will arrive soon, so keep reading!

Depending on the type of immigration process you are starting, the United States Citizenship and Immigration Service (USCIS) will need to summon you to register your fingerprints.

If your immigration process requires it, USCIS will send you a notification to the address you have declared, with the information you will need for your appointment.
Approximately 5 to 8 weeks after submitting your immigration application, you will receive a notification from USCIS asking you to attend an interview and obtain your biometric data.

The biometrics appointment can be made at a local USCIS office, but it can also be made at the US consulate near where the alien lives. In addition to taking fingerprints and photography, the foreigner’s signature must also be recorded.

Usually the appointment for biometric data is very fast, depending on the number of people who have made an appointment on the same day and time, but once it is your turn, you will see that it will only take 10 to 15 minutes to register.

 

What are biometric data used for?

USCIS will need to register your fingerprints and your photograph as it will be used to match the FBI database and the Department of Homeland Security (DHL) and check if you have a serious criminal record or any past immigration violations.

The fee to be paid to perform the biometric data is $85 dollars. This amount must be paid at the time of filing your immigration process with USCIS.

The citation for the biometric data is the first thing that will happen after you have submitted your application to USCIS. Only the beneficiary of the immigration process must attend, it is not necessary for the sponsor to attend it, since the biometric data will not be taken from them.

What should you bring to your biometrics appointment?

 

  • A photo ID, such as your passport or driver’s license.
  • The notice you received from USCIS informing you of the date and place of your biometric services appointment.
  • Any other notice or receipt notice you have received from USCIS.
  • Any other documents that USCIS specifically requested in your appointment notice (generally, any previous employment authorization documents or travel permits issued in your name)

Depending on a few factors, you may be called for a second appointment for biometrics. This does not mean that there is something wrong with your process. Most of the time the second appointment is because the fingerprints were smudged and unusable.

It may also happen that your biometric data has expired before your application has been processed. The validity of biometric data is 15 months.

It is legal to transport any type of currency or monetary instrument, regardless of the amount, and does not entail the payment of any tax. However, you must meet a requirement if you want to transport more than $ 10,000.

The only requirement to be able to enter more than $ 10,000 to the United States is to declare the exact amount. The declaration is made through a form called “Report of International Transportation of Currency or Monetary Instruments” (CMIR, for its acronym in English). Entering with more than $ 10,000 and not completing the form is considered a federal offense.

WHAT IS THE EB5 PROGRAM?

The EB5 program was created in 1990 by the United States Congress to stimulate the US economy through job creation and investment from foreigners.
To be eligible for the EB5 visa: one of the important requirements is that the investor must invest the required amount of capital in a new business creating at least 10 qualified jobs.

Some of them include letters of recommendation, validation of academic documents, demonstration of financial solvency, and previous qualifications. However, college acceptance is based primarily on SAT, ACT, and TOEFL test scores.

First, we find the SAT exam, an exam required by certain universities to be able to apply to.

The ACT is based on a scale of 1 to 36 points. This score is obtained by the sum of points obtained in each of the sections. Amount of best points that can be obtained on this exam is 36 points, and the average is 21 points. Finally, the price of the exam varies between $ 50 and $ 67. Lastly, there is the test called TOEFL.

In this case, the TOEFL is a test that only assesses the quality of a person’s English language. It evaluates the skills and abilities of a student when communicating, understanding, and writing in English. Like the ACT and the SAT, the TOEFL is given depending on whether the university you are applying to requires it. The structure of this exam is divided into 4 main sections; Reading, Listening, Speaking, and Writing. In total, the exam takes 3 hours and is performed on a computer that is insured by specific testing centers. Each section of the exam is evaluated on 30 points and the total of the exam on 120. Regarding the scores, the perfect score is obtaining 120 points while the average is 84 points.
